Andre 3000 sued over Class of 3000 Cartoon.


Andre 3 Stacks might be a couple stacks shorter if this lawsuit goes through.

A Boston postal worker is suing OutKast frontman Andre 3000, the Cartoon Network and Turner Broadcasting for $2 million in damages, saying they ripped off his idea for an animated series about a group of young musicians and aired it as “Class of 3000.”

Timothy McGee, 33, a former art student, claims he developed “characters, artwork, storylines . . . and concepts” for an animated series he called “The Music Factory of the ’90s,” nearly 10 years before the oddly similar “Class” began airing on the Cartoon channel.

McGee’s show followed a group of young musicians “as they try to break into Atlanta’s burgeoning music scene,” the suit says.

His characters included “a young corporate type” who dreams of being a music producer, a “tough full-of-attitude female executive, a young techno-whiz sound engineer, a talented young Asian singer and a central energetic young singer/rapper.”

McGee proposed that Kenny “Babyface” Edmonds host the show.

In 1997, the Boston guy submitted a proposal for his show to Michael Lazzo, then a vice president of programming for the Cartoon Network, and promptly received a rejection letter.

Nine years later, in November 2006, the Cartoon Network premiered “Class of 3000,” an animated series set in Atlanta.

The Emmy Award-winning show ran for two seasons and featured a cast of young musicians in Atlanta. The characters included an energetic, aspiring music producer, a “tough, brash full-of-attitude” female string player, a “technological genius bass player, and talented twins of Asian ethnicity,” the suit says. The show’s host and main character was voiced by Andre 3000.

“The artist known as Andre ‘3000’ Benjamin was credited with the creation, executive production and starring role in ‘Class of 3000,’ ” the suit states. “The similarities between the expression of Mr. McGee’s work in ‘The Music Factory’ and that of ‘Class of 3000’ are sufficiently detailed and pervasive.”

The suit claims copyright infringement, breach of contract and misappropriation of trade secrets and requests damages “including but not limited to” all the profits from the show, legal fees and “whatever this court may deem additionally just and proper.”

“We’ve requested $2 million in damages thus far and the rest remains to be seen,” said McGee’s attorney, Jerrold Neeff,, a Boston University law professor.

A spokeswoman for the Cartoon Network said the network is aware of the suit, but “as a general practice, we don’t comment on litigation.”

    timothy mcgee juss jealous cuz he show ddnt go as far as andre’s in fact his show ddnt go nowhere so he thought it was right to be racist & sue him for havin a similar idea as him & bein successful with it
